Welcome to Alicia Telfer Photography (“Company,” “we,” “us,” or “our”). By accessing this website or booking services, you agree to the following Terms of Service. Please read them carefully.

1. Use of This Website

By using this website, you confirm that you are at least 18 years old or have permission from a parent or legal guardian. You agree not to:

  • Use this website for unlawful purposes

  • Copy, reproduce, or distribute content without written permission

  • Attempt to interfere with the website’s security or functionality

All website content, including images, text, branding, and design, is the intellectual property of Alicia Telfer Photography and may not be used without prior written consent.

2. Photography Services

Booking & Payment

  • A signed agreement and retainer are required to reserve any session or event date.

  • Retainers are non-refundable.

  • Remaining balances are due prior to or on the date specified in your contract.

  • No images will be delivered until payment is received in full.

Cancellations & Rescheduling

  • Rescheduling requests must be made in writing.

  • Retainers may be transferable one time at our discretion.

  • Cancellations result in forfeiture of the retainer.

  • Weather-related rescheduling is determined at the photographer’s discretion.

Creative Control

You acknowledge that you are familiar with the Company’s portfolio and style. Final image selection, editing style, and artistic decisions are at the sole discretion of the photographer.

3. Digital Images & Usage Rights

Unless otherwise stated in a signed agreement:

  • Clients receive a non-exclusive, non-transferable personal or commercial license (depending on package purchased).

  • Copyright remains with Alicia Telfer Photography.

  • Images may not be altered, filtered, or edited without written permission.

  • Images may not be sold, submitted to contests, or used for commercial gain beyond agreed terms.

For commercial clients and retainer packages, usage rights will be outlined in individual service agreements.

4. Prints & Framing

All prints and framed products purchased through our frame shop are custom-made.

  • All sales are final once production begins.

  • Minor color variations may occur due to screen calibration differences.

  • We are not responsible for damage after product delivery.

  • Clients are responsible for reviewing sizing and specifications prior to approval.

5. Workshops, Headshot Events & Group Sessions

  • Payment is required to reserve your spot.

  • Due to limited capacity, cancellations are non-refundable unless otherwise stated.

  • We reserve the right to cancel or reschedule events due to low enrollment or unforeseen circumstances.

  • In the event of cancellation by us, you will receive a full refund or credit.

6. Subscription & Retainer Services

For clients enrolled in monthly or recurring photography packages:

  • Minimum commitment terms will be outlined in your service agreement.

  • Payments are due according to the agreed schedule.

  • Late payments may result in paused services.

  • Usage rights are defined per agreement and may vary depending on commercial scope.

7. Model Release

Unless otherwise agreed in writing, the Company reserves the right to use images for:

  • Portfolio display

  • Website and social media marketing

  • Studio samples

  • Educational or promotional purposes

If you wish to opt out of public usage, written notice must be provided prior to your session.

8. Limitation of Liability

To the fullest extent permitted by law:

  • The Company is not liable for circumstances beyond its control, including but not limited to weather, venue restrictions, acts of God, equipment failure, illness, or emergencies.

  • In the unlikely event of total image loss or failure to deliver, liability is limited to a refund of payments received.

  • The Company is not responsible for client dissatisfaction based on subjective preferences.

9. Turnaround Time

Delivery timelines vary depending on service type and will be communicated in your agreement. Delays caused by incomplete payments, client responsiveness, or peak seasons are not grounds for refunds.

10. Third-Party Links & Services

This website may contain links to third-party services. We are not responsible for the content, privacy practices, or policies of those third parties.

11. Privacy

12. Indemnification

You agree to indemnify and hold harmless Alicia Telfer Photography from any claims, damages, or expenses arising from your use of this website or services.
